John Taylor

John has an extensive career in law. John completed a Bachelor of Arts in 1982 and Bachelor of Laws from Australian National University in 1985. John commenced his legal career in the Australian Capital Territory in 1986. John has been admitted as a solicitor in the Australian Capital Territory, the State of New South Wales and the State of Victoria.
Having been raised in Finley, John returned to Finley with his young family to commence work as a solicitor in October 1988. In 1991, he went into partnership with Peter Whitty and the firm Taylor & Whitty was formed.

John has extensive knowledge and experience of commercial and property law. He regularly acts for clients in the sale and purchase of residential, commercial and rural property. He has extensive experience in preparing, giving advice and negotiating high value property transaction, business transactions and leases (both rural and commercial). John regularly works in matters involving intergenerational farm transfers, trusts and superannuation funds.
John has represented clients in civil litigation matters ranging from contractual disputes, negligence claims, estate disputes and challenges to government decisions. John has acted as an instructing solicitor in the High Court of Australia, the Court of Appeal, Supreme Court and District Court in NSW.

John is a member of the Criminal panel for Legal Aid in NSW. John has had significant experience in representing persons accused of crimes and civil wrongs. John has acted as an instructing solicitor in the Local Court, District Court and Supreme Court of NSW in criminal matters.

John assists clients in deceased estate matters. John has assisted clients in obtaining grants of probate and letters of administration from the Supreme Courts in both Victoria and NSW. He has acted for clients in both commencing and defending family provision claims in both Victoria and NSW. John also regularly drafts complex wills taking into account trusts, businesses and superannuation.

John’s wealth of knowledge and experience assists clients in their legal matters, whether simple of complex. John has the ability to cut to the heart of complex legal issues and ensure he gives clear and accurate advice to his clients.
John was involved in the following cases:

  • RT & YE Falls Investments Pty Ltd v State of New South Wales [2007] NSWCA18 – The firm acted for a client where the Respondent, having made representations, had a duty not to leave the client in error where circumstances had changed so that the representations were no longer true.
  • Tulloch (deceased) v Braybon & Ors (No. 2) [2010] NSWSC 650 – The firm acted for a client who successfully defended a claim that a gift (being a 50% share in a racehorse) was not valid, or if it was valid, that the gift was made due to undue influence.
  • Horne v James [2015] NSWSC 465 – The firm acted for clients who successfully defended a claim of specific performance to sell land and water to the Plaintiff at a particular price.
